Does posting an MSDS on the Internet satisfy transmission requirements?

Yes, posting your MSDS on the internet will satisfy the transmission requirements as long as all necessary regulations set out by the Hazardous Products Act (HPA) are fully met.  First of all Section 13 of the HPA 'places a legal requirement on the Canadian supplier of a WHMIS controlled product intended for use in a work place in Canada to transmit a MSDS disclosing prescribed information as a condition of sale.'  Also Section 14 of the HPA 'places a legal requirement on the Canadian importer of a controlled product to obtain or prepare a MSDS as a condition of importation.' Furthermore Section 23 of the Controlled Products Regulations (CPR) states 'the Canadian importer who imports a controlled product in accordance with subsection 23(1) must obtain or prepare a MSDS before the controlled product is used or sold in Canada.'

Under these regulations the supplier of the chemical product must ensure the following:
'The person to which the product is being sold has full access to the correct MSDS at the time of sale.  This MSDS must contain all of the correct and necessary information regarding the disclosing requirements of both the Hazardous Products Act and the Controlled Products Regulations, or whichever applying Acts must be taken into consideration for the specific jurisdiction in question.

'The MSDS must be submitted to the purchaser in the correct official language of the jurisdiction.  If this is not specified to the supplier, then the language in which communication has been transferred between the supplier and purchaser is acceptable. If more than one language is requested, the supplier must comply with the demandsof the purchaser.  This may result in multiple MSDS's; one for each official language within the jurisdiction.  

'The MSDS, if submitted over the internet, must be in a fully readable manner when downloaded by the purchaser. There must not be any pages or sections missing from the MSDS, it must be in the same complete and final form as any paper copy of the same
